NOTICE OF SHERIFF'S SALE NOTICE IS HEREBY GIVEN That pursuant to an Amended Writ of Execution issued in the Circuit Court of Manatee County, Florida, on the 29th day of November, 2018, in the cause wherein KAREN LYNN EPPOLITO HARGRAVE, was plaintiff and RICHARD BRUCE HARGRAVE, was defendant being case number 2015DR2244, in said Court, I, Charles R. Wells, as Sheriff of Manatee County, Florida, have levied upon all the right, title and interest of the DEFENDANT, RICHARD BRUCE HARGRAVE, in and to the following described real property, to-wit: Address where Property is Located: 7507 Riverview Drive Bradenton, Florida 34209 Description of Property: PROPERTY APPRAISER'S PARCEL ID# 3002000002 Legal Description: Lot 52, less the Easterly 10 feet, and Lot 53, SHAW'S POINT, as per plat thereof recorded in Plat Book 10, Pages 65 and 66 of the Public Records of Manatee County, Florida This is one-half interest of tenants in common with the Petitioner, Karen Lynn Eppolito Hargrave. The one-half interest is subject to Petitioner's rights pursuant to the Final Judgment of Dissolution of Marriage with Minor Children entered in the above-captioned action on August 11, 2015, which ratified and incorporated the Marital Settlement Agreement filed in the above-captioned action on May 26, 2015. Pursuant to said Marital Settlement Agreement the Petitioner, Karen Lynn Eppolito Hargrave, has the right to possession of the property and the obligation to pay the mortgage thereupon. In the event the Property is sold during her lifetime, the Petitioner, Karen Lynn Eppolito Hargrave, has the right to set the sale price of the Property and the right to the first $312,000.00 in proceeds. Thereafter, the Respondent/Judgment Debtor is entitled to fifty percent (50%) of the proceeds. In the event that Property is sold after the death of Petitioner, Karen Lynn Eppolito Hargrave, the Respondent/Judgment Debtor is required to sell the Property and the proceeds are to be equally split between Vanessa Hargrave, Madelaine Hargrave, and any child still alive of Respondent/Judgment Debtor's first marriage. and on the 12th day of February, 2019, at the Crime Prevention Unit located at 600 US Hwy 301 Blvd West Ste 202, Bradenton, Manatee County, Florida, 34205, at the hour of 10:00 a.m., or as soon thereafter as possible, I will offer the said property for sale at public outcry and will sell the same, SUBJECT TO ALL TAXES LIENS AND ENCUMBRANCES, if any, to the highest and best bidder for CASH IN HAND, the proceeds to be applied as far as may be to the payment of costs and the satisfaction of the above described execution.
